The offer and sale of products on our website "www.maternatura.it" are governed by these Conditions of Sale, which apply to every proposal, order and order confirmation for the purchase of products. Confirmation of the order by the Customer constitutes acceptance of these Conditions of Sale.

TIMING AND PRICES.

Method of purchase.Before submitting the purchase order, the customer is required to read the general conditions. The submission of the order implies their automatic acceptance. The customer purchases the product, the characteristics of which are illustrated online in the relevant sheets, at the price indicated and to which is added the shipping costs as stated on the website. Before confirming the purchase order, the unit cost of each selected product, the total cost in case of purchasing more than one product, the cost of additional charges according to the selected payment type and the amount of shipping charges will be summarized. Once the purchase order is confirmed, the customer will receive an e-mail confirming receipt and acceptance of the order, containing all the information about the purchased products, detailed indication of the price, shipping costs, applicable taxes and means of payment and to information about the right of withdrawal. With the sending of the confirmation email, the purchase contract is considered concluded and formalized. Maternatura.it reserves the right not to accept or not to process orders that are incomplete or missing essential data.

Delivery times and methods Maternatura.it will deliver the products selected and ordered by the Customer in the manner referred to in the preceding article through BARTOLINI. Delivery times, in accordance with the provisions of art. 6 of Legislative Decree no. 206/2005, are on average 3 days and not more than 30 days from the day following the day of transmission of the order. The invoice will be issued to the Customer in the shipped package, using the data entered by the Customer during registration on the website. For this purpose, we recommend that you enter your Tax Code.

Prices and product details.All sales prices of the Products on the website are expressed in Euro and include VAT and any other taxes. Any promotions are to be considered valid only for the online store. The prices applied are those indicated on the Website at the time of the purchase order by the Customer. Product prices published from time to time cancel and replace previous prices and are subject to actual product availability. Product images are for illustrative purposes only.

METHODS OF PAYMENT, TRANSPORTATION AND DELIVERY

Paypal: the customer can make payment through the Paypal circuit, using a personal Paypal account or choosing not to register for the Paypal service. In the event that the payment is not made within 2 days from the date of the order, unless otherwise agreed between the customer and Maternatura.it, the order will be canceled without any notice. With the Paypal system, it is also possible to pay with Visa and MasterCard credit cards. There is no surcharge.
Visa and MasterCard credit card: the customer can make the payment through Credit Card, the amount will be charged only after completing the purchase. There is no additional charge.

TRANSPORTATION

The goods travel on behalf of and at the risk of the buyer: therefore, Maternatura.it will not be responsible for any delays or damages resulting from transportation. In the event that the package arrives visibly damaged withdraw the package by signing with reserve, otherwise no refund will be possible. In the event of a rejection of the package, Maternatura.it may ask the customer for the full amount of shipping costs and the cost incurred for the return of the package to the sender. The delivery terms indicated by Maternatura.it refer to the products in stock and are to be considered non-binding since the same may be modified by Maternatura.it in case of actual needs. Maternatura.it reserves the right to make delivery of products related to the same order in several deliveries without further charge to the customer. Special conditions and terms of delivery must be agreed in advance by email or telephone between the Customer and Maternatura.it and accepted by both parties. Any special offers or promotions proposed by Maternatura.it are valid until the expiration of the same or, until the products being promoted are sold out.

SHIPMENTS

For shipments in Italy Maternatura.it requires a contribution of € 5.90 vat included for orders up to 48.99 euros. From 49.00 euros onwards, shipping costs are free. The promotion is valid only for purchases in Italy.

For shipments within Europe, costs are € 14.99.

For Extra-EU shipments, costs are to be determined by country.

PRODUCT WARRANTIES

Maternatura.it guarantees only the material integrity of the products at the time of delivery. Any defects must be reported by the customer, under penalty of forfeiture, no later than 10 (ten) days from the date of delivery. The customer is entitled to the replacement of damaged products upon return of the same, excluding the customer's right to compensation for any damage, even further. Shipping costs necessary for the replacement of products are to be considered the responsibility of the customer. Maternatura.it does not provide any additional guarantee on the products other than that provided by individual manufacturers. Except in cases of willful misconduct or gross negligence of Maternatura.it, it is agreed that- Maternatura.it's liability shall not exceed the price of the products purchased by the customer under dispute.

RIGHTS OF WITHDRAWAL

For contracts concerning the sale of goods, where there has been delivery of the goods, the substantial integrity of the goods to be returned is an essential condition for the exercise of the right of withdrawal.

In order to exercise its right of withdrawal, the Customer must contact "Maternatura" within 14 days of delivery of the products with a written notice sent by e-mail to the address info@maternatura.it containing all the necessary and useful information for proper processing of the practice of return and refund.

In order to facilitate the refund practice, we ask you to communicate the following in your communication:

1. your express desire to withdraw from the purchase contract;
2. the order number and the copy of the document proving the purchase of the order with respect to which you intend to exercise the right of withdrawal;
3. the description and codes of the Products with respect to which the right of withdrawal is exercised;

The refund of all payments made by the Customer, with the exception of the cost of return, will be made by "Maternatura" in accordance with the Consumer Code and using the same means of payment used by the Customer for the initial transaction, unless the Customer expressly requests otherwise.

Following the receipt of the communication with which the Customer communicates its willingness to exercise the right of withdrawal, "Maternatura" verified the correspondence to the requirements of the Consumer Code, will communicate by e-mail to the Customer how to make the return of the products. The return of products in favor of "Maternatura" must be made within the period of 14 days from the date on which he communicated the decision to withdraw from the contract.

From the receipt of the products, until their eventual redelivery, the Customer is required to keep and guard with the utmost care and diligence the products received and for which he intends to exercise the right of withdrawal, keeping them intact together with the original packaging, internal and external as well as all accessories. All costs and risks resulting from transport operations for the return of the products are the full responsibility of the Customer, except for the right of the latter to insure the shipment, bearing the related costs. It 'allowed only the return of products by courier or postal service.

Effects of withdrawal: If the right of withdrawal is properly exercised, the Customer is entitled to reimbursement of any amount already paid by way of advance payment, while the shipping costs for the return of the product to "Maternatura" and any damage suffered by the returned product remain the responsibility of the Customer.

Please note: The right of withdrawal can be exercised only if the goods are perfectly intact in every part and not used. Therefore, the returned packages must not have been opened, deprived of the wrapping or parts thereof, nor bear any signs of tampering. "Maternatura" is not responsible for any damage to the products occurred during the return shipment of the same. Should "Maternatura" receive damaged or tampered return items, it will not refund the amount paid for the purchase of the products.

APPLICABLE LAW AND DISPUTE RESOLUTION

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005 on distance contracts and by Legislative Decree No. 70 of April 9, 2003 on certain aspects concerning electronic commerce. In the event of disputes between Mater Natura Srl and each end user, arising from the General Conditions of Sale, the competent court shall be that of VERONA.

MODIFICATION AND UPDATING

The General Terms and Conditions of Sale shall be amended from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on www.maternatura.it.
